  • Elderly Lady Having Phone Call.
  • Neighbor keeps reporting me to HOA for completely made up violations

    I'm in a HOA neighborhood which I already regret but whatever. My neighbor Patricia (70sF) has filed 8 HOA complaints against me in the past 6 months.
  • EIGHT. All completely false. She reported my grass was too long (it wasn't I literally measure it), that my house numbers were the wrong color (they're the exact color specified in HOA rules), that I had a unapproved storage shed (I don't have any shed), that my mailbox was damaged (its brand new), and last week she reported that I'm running a business out of my home (I work a regular office job).
  • Every time the HOA has to send someone to verify and every time they find nothing wrona.
  • But I still get the notices and have to deal with it. The HOA lady told me Patricia has filed more complaints against me than anyone else in the 15 year history of this neighborhood.
  • I confronted Patricia and asked why she keeps making false reports. She said "I'm keeping our neighborhood standards high" and that she doesn't trust me because I "look suspicious." I'm a 35 year old accountant who wears glasses and drives a Prius.
  • What's suspicious about that?? My wife thinks Patricia is bored and lonely and this is how she entertains herself.
  • But its harassment at this point. Can I sue her for this? The HOA wont do anything about her.

  • Ikeamademedoit Get a lawyer to write a letter to the HOA about the harassment and going forward you will no longer allow them to inspect your property as its now clearly harassment and what are they, the HOA, going to do about this before they become liable as part of the documented harassment
  • Agitated_Cow_4325 Original Poster's Reply I'm actually considering this. Will that get me somewhere? Our will she just received warning or anything? I respect elders but she's too much. I'm already stressed enough with my work and she's adding more..
  • alwaysboopthesnoot Inform the HOA board that Patricia's behavior has now risen to the level of harassment. Next time, you'll report her to the police and name them the HOA b/c they are doing nothing to rein her in and simply allow this pattern of harassment to continue-even acknowledging to you that she is targeting you, specifically. Attempt to make the report as a criminal complaint and not a civil matter, telling the police that your neighbor said you were suspicious and is now targeting you;
  • Agitated_Cow_4325 Original Poster's Reply Thank you sir this is informative. I will seriously look into this. Maybe I will tell this to her and if nothing changes, then so be it. Am I wrong about that? I know she's old and I respect elders but what she's doing really getting into my nerves
  • katiekat214 The HOA cannot fine her for false reports. They can only fine for what is in the rules and regulations, and those are dictated by what is in the legal documents that set up the neighborhood, the Covenants, Conditions and Restrictions - the list of permissible and non-permissible things that can be done to or around a property by the homeowner, what property is owned by the homeowner and what is owned by the HOA, who is responsible for repairs and maintenance of each part, etc. Any re
  • Agitated_Cow_4325 Original Poster's Reply Exactly as this guy says.. she's uncanny
  • thegreatgazoo Sounds like you need to find things she's doing wrong and get her fined for real.
  • CuteYou676 Maybe a cease and desist letter to Patricia too, so that she is aware that it's now on record.
  • DysfnctionalbyChoice Maybe add in that you are worried that she may start involving the police in her lies and depending on what she reports you are scared it could end very badly.
  • OneLessDay517 You need to ask your HOA Board or management company why they are assisting Patricia in her very clear harassment campaign against you. Throwing that word at them might give them pause the next time a complaint comes in. Why are violation notices going out without clear proof (a photo) of a violation (particularly in the case of a shed that doesn't exist or a damaged mailbox)? My HOA does not send a violation without a photo. Ever.
  • TheGarbage PatchKid Forgive me because I do not know how HOA's work, but I don't understand why the HOA has not fined her for false reports- especially since they admitted to you that she does this to more than one neighbor. If I kept having to investigate obvious false reports only 3 times from the same person, I would never take them as honest/ legitimate ever again.
